Enliven Health is the trading name of Enliven Health Ltd, Company number 09852207. Please read these Terms and Conditions carefully. These Terms and Conditions apply to any of the services provided by Enliven Health Ltd, through the Website, Social Media or in the clinic or studio. Your usage or purchase of any of the services or products provided by Enliven Health Ltd, in the clinic, studio or through the website or social media will be subject to these Terms and Conditions and you are hereby agreeing to them. You should read these Terms and Conditions before you agree to any of the services provided at or through Enliven Health.

Pilates Class Terms and Conditions

Classes may be booked by telephoning 01908965007 or by emailing info@enlivenhealth.co.uk, or in person.

Classes are always subject to availability but we will do our best to accommodate you into your chosen class.

Enliven Health DOES NOT offer refunds for paid for classes.

All classes must be prepaid for at the time of booking.

A pre-assessment session will always be offered prior to clients attending a class and if they refuse this session, they do so at their own risk.

All sessions [Classes and private sessions] are subject to a 24 hour cancellation policy. If you fail to give less than 24 hours of notice of cancellation of a class or miss a class you will be charged in full for this class and no refund will be provided.

Refunds or substitute classes will not be given if you miss a class without notice.

In the event of us cancelling a class, a substitute class will be arranged, however a refund will not be provided.

If you provide more than 24 hours notice of cancellation of a class you will not be refunded for this class, however an alternative class will be offered, subject to availability.

If a class is missed within a block booking, it may not be carried over into subsequent block bookings.

If you have block-booked a course of private sessions and fail to give more than 24 hours notice of cancellation, or if you fail to attend a session, that session will be charged and will count as a session of the block booking. If you provide 24 hours of notice of cancellation, that private session may be rebooked.

Private session block bookings must be used within 3 months of booking.

If you book a 1:2 or 1:3 private Pilates session and one or more people do not attend, the remaining person will be liable for the full cost of the session.

If clients turn up 10 minutes or more after the class has started, they may not be able to take part in the class. The warm-up is an important part of the class and you risk your own health and safety by turning up late.

Clients will not be able to transfer their sessions to any other client or allow any other person to use their session.

Class fees may be changed from time to time. We shall give clients at least 14 days notice of any changes if this is the case.

Private Pilates and Physiotherapy Terms and Conditions

Private Pilates and Physiotherapy sessions are subject to a 24 hour notice cancellation policy. Any booked sessions must be cancelled within 24 hours prior to the session.

Bookings and Cancellations may be made via email info@enlivenhealth.co.uk or by calling 08448845424. Appointments are subject to availability.

If you have made a block booking of private sessions or treatments and do not provide 24 hours notice or more of cancellation, you will be charged for the missed session and will not be refunded.

If you miss 3 sessions in a row [even by giving 24 hours notice or more] you may be discharged from the clinic and charged for the third appointment fee.

Block bookings of Pilates or treatment sessions must be used within a 3 month period.

Clients may not transfer their treatment bookings to any other person.

Treatment costs may be increased from time to time. Enliven Health will provide at least 14 days notice of any such increases.

If you arrive late for your appointment, the appointment will be started from the time of your arrival and will finish at the scheduled appointment’s time. If you wish for the session to be extended, you will have to pay for any additional time this may involve.

The rights of cancellation and refund any any limitation expressed in these Terms and Conditions do not affect your statutory rights as a consumer.

Private Medical Insurance Clients

If you have Private Medical Insurance and you fail to attend an appointment without giving at least 24 hours prior notice, you may be charged personally for the missed session, if your insurance company will not cover the cost of the session.

It is your responsibility to ensure that your Private Medical Insurance company will cover any costs for any services you receive by us, prior to receiving such services.

Liability Statement

It is you as the client’s responsibility to ensure you are medically fit to take part in exercise, prior to attending a treatment, class, Pilates session or a class induction, to ensure that the service provided is suitable for you.

A pre-assessment session will always be offered to you before you attend, to ensure you are familiar with the principles of Pilates, to go through the principles of health and safety and to discuss your medical status. If you as the client refuses a pre-assessment session, you do so through your own informed consent and at your own risk.

A Pilates health and medical questionnaire must be completed prior to you attending a class or Pilates session. If you choose not to complete this, you do so at your own risk.

Clients are responsible for informing their Physiotherapist and Pilates instructor if their medical status changes. Enliven Health Ltd or its members of staff will not be liable for any incorrect information or any information not supplied by you to us, to inform us of your medical status, and as such, will not be liable for any injury which may result.

Clients are advised that if they have any concerns regarding their medical status, they consult their GP to seek medical advice, prior to attending any classes, Pilates sessions or treatment sessions.

The information and services provided on the site, in the clinic or studio by Enliven Health do not qualify as medical advice and clients are reminded that it is their responsibility to determine they are medically fit and well through obtaining appropriate medical advice, to ensure that such contents and services provided by us will be suitable for you.

We do our best to make that all the information provided through our website and services is up to date and accurate, however we do not accept any liability for any error or omission and exclude all liability for any action you or your representatives may take, or any loss or injury you may suffer as a result of relying on any information provided through any service by us to you.

We cannot guarantee that our website will be free of viruses or bugs.

Warranties

Physiotherapists at Enliven Health are members of and are regulated by The Health Care and Professions Council [HCPC] and are members of the Chartered Society of Physiotherapy [CSP].

Enliven Health Ltd warrants that its services will be provided with reasonable skill and care. We cannot guarantee the outcome of any of the treatments and services provided by us to you.

Transfers

Classes and Treatment sessions may be sold in blocks of 5, 10 or such other combinations as Enliven Health Ltd may introduce from time to time. Blocks of classes and treatments are non-refundable.

Definitions

In these terms and conditions, the following definitions apply: ‘The Company” refers to Enliven Health as the service provider, ‘The Client’ refers to the service user, “Services” means any information and services ordered and/or provided by Enliven Health ltd through the website, Social Media or directly at the clinic or studio and all services offered as part of any course or workshop. Any electronic information supplied to you by Enliven Health will constitute part of the “service”, not a product. “Products” means any products offered for sale on the website or at the clinic/studio. “Site” means the web site at the URL www.enlivenhealth.co.uk, or replacement site which may be used from time to time.

Your Personal Information

Usage of your personal information is governed by the Enliven Health Ltd Privacy Policy, which forms part of these Terms and Conditions.

Suspension and Termination of Service

Enliven Health Ltd may suspend the operation of the site for repair or maintenance work or in order to update or upgrade the contents or functionality of the site from time to time. We do not need to provide notice for this suspension and will not be liable for any loses incurred by you as a result.

Enliven Health Ltd may terminate it’s services to you immediately if you use offensive, threatening or abusive language or behavior, or if you make attempts to defame or damage the reputation of the Company or any of it’s employees in any way, or in the event you breach any of these terms and conditions or do not pay any sums due to Enliven Health ltd [including the credit/debit card you use is not valid or does not work for another reason].

Pricing

Information displayed on the site or in our clinic or studio as to pricing and availability is subject to change by Enliven Health Ltd without notice, however clients will be provided with 14 days notice of any price changes.

Your Privacy

We take your privacy very seriously at Enliven Health and this extends to any personal data we may collect or receive from you. You are directed to read our Privacy Policy, which forms part of these Terms and Conditions.

Any information submitted to us via our website or by you in any other way is held under the terms of the Data Protection Act 1998, and will comply with the General Data Protection Regulations of May 2018.

Intellectual Property

The full content of this website is copyright of Enliven Health ltd, which is a trademarked brand. The content is for your own personal usage only, and you must not copy or reproduce any content in any way, without prior written permission. This includes but is not restricted to written content, blogs, layout of the website, name and logos.

You must not use the site for any other purpose than that it is meant for and Enliven Health will comply with lawful activity and enforcement to prevent any unlawful action with regards to usage of this site and/or social media pages.

You must not use threatening language or behaviour, or harass, provoke or defame The Company or its employees in any way, including through Internet activity and social media activity, or any other way which may be detrimental to the reputation of Enliven Health, or which may deter other people or potential customers from using the site, products or services.

Enliven Health reserves the right to block or remove any correspondence or actions made by you, if they are deemed to be detrimental to the reputation or operation of the company.

Enliven Health is not responsible for any information and services which may become available through third party websites or pages.

General

These Terms and Conditions apply to all users of the website and of any of the services provided at Enliven Health. If you do not accept these Terms and Conditions, then you should stop using our services and website immediately. Your usage of the services we provide, including the website constitutes your consent to these Terms and Conditions.

Enliven Health may change these terms and Conditions from time to time. You should check them each time you use the Website or any of our services.

These Terms and Conditions supersede all previous agreements, understandings and representations relating to the subject matter.

These Terms and conditions shall be governed and interpreted in accordance with English Law, and you consent to the nonexclusive jurisdiction of the English courts.
